Passaic Avenue Developer Defeated
The developer who has been embroiled in a years-long fight regarding a proposed multi-family development on Passaic Avenue suffered another setback recently as the township Planning Board denied his application to construct two single-family homes on the lot. The proposal would have required a variance to allow for a deficit in lot frontage.

Attorney Thomas DiBiasi presented the idea as an alternative to going to court to appeal the July 25 Superior Court ruling which overturned the Nutley Zoning Board's granting of variances in this case. Initially, the developer proposed building a 12-unit apartment building on the site. The case may wind up back in court yet again (see below).
 

Passaic Ave. Coalition May Be Headed to Court (Again)

(Oct. 21) The Passaic Ave. coalition received notice of an appeal following their recent victory in Superior Court.  The appeal was filed by attorney Tom DiBiasi on behalf of the developer, Rosalie Catanzarite.

The appeal follows a decision on July 25th by Superior Court Judge Verna Heath to overturn the Nutley Zoning Board's granting of variances to Catanzarite. The lot is zoned R-1A, which is intended for a single-family home. Catanzarite proposed to build a 12-unit apartment building.  No court date has been set.
